It is important that all individuals make a valid will. We can also assist you in obtaining a Grant of Probate and in administering estates.

The death of a loved one can often be a fraught time for a family. It is often helpful to have independent and impartial advice and assistance when dealing with their assets and finances. Hervey Dickens Solicitors can assist you with any issues that may arise in enacting a loved one's will or dividing their assets, otherwise known as probate.

Family Law

We provide advice on divorce, children cases and all other family matters. 

Going through a divorce or dissolution of a civil partnership is obviously a difficult and emotional time. Our team aims to make this process as easy on you as possible. 

We will always take a non-confrontational approach to a relationship breakdown where this is possible. Of course, divorce or dissolution may not always be the answer. Many problems in marriage can be overcome by talking. 

Some people may wish to separate but not yet make things formal by divorce or dissolution. In such a case, they can consider a separation agreement, or judicial separation. We are able to give advice with regard to either of these options.

If a final, legally binding separation appears to be the only option available to you, a petition can be drawn up fairly simply and cost-effectively. Any disputes or disagreements between you and your partner will obviously require more specific attention.

If you prefer, we can conduct your case solely by email (save for certain court documents which require original signatures) after the initial appointment.

Children Matters

When a relationship breaks down, most people would agree that the well-being of any child is the most important matter. It is of the utmost importance that you both remain parents, no matter what the state of your own relationship. It is also important not to expose your children to inappropriate information about the relationship breakdown or your own negative feelings about the other parent. This can be extremely harmful to a child’s well-being. 

Some children can even show signs of serious emotional disturbance after the breakdown of their parents’ relationship, and we can give you details of agencies who may be able to help them. We understand how emotional issues concerning your children can be and aim to offer you the best advice possible throughout this difficult time. 

In the vast majority of cases both parties are able to settle their own arrangements, sometimes with the help of a mediator. We can arrange mediation sessions quickly and easily.

Sadly, some cases cannot be settled in this way and require a court application. We can give advice and assistance both before and during court proceedings relating to children.
